Homeowner guide

Got a sidewalk violation on Staten Island? Here's what to do.

A plain-English guide to NYC DOT sidewalk violations: your deadline, the permit, the repair and getting the violation dismissed.

Step by step

From notice to dismissal.

  1. 01

    Read the notice

A Notice of Sidewalk Violation from NYC DOT lists the defects found in front of your property. There is no fine, but the violation is filed with the County Clerk until the repair is confirmed, which can complicate selling or refinancing.

  2. 02

    Note your 75-day deadline

You have 75 days to make the repair, counted from the certified mail receipt date or the posting date. If the work isn't done, DOT can hire its own contractor and the Department of Finance bills you. Getting a permit does not extend the deadline.

  3. 03

Get a permit before work starts

A DOT Sidewalk Construction Permit is required before any sidewalk repair. When a contractor does the work, the contractor applies through NYC DOT's online permit system.

  4. 04

    Repair to DOT specifications

Damaged flags are removed and replaced to DOT specifications for thickness, base, joints and finish, so the work passes inspection.

  5. 05

    Request the dismissal inspection

After the repair, request a Sidewalk Violation Dismissal Inspection through NYC 311. Have your permit number, address, block and lot, and violation number ready, and keep the whole sidewalk clear for the inspector.
